Projects

Confidential – TergoPower Renewable Energy Biomass CHP Plant, Poland (2020)

The client undertook due diligence in connection with the potential acquisition of an equity position in TergoPower’s Stage 4 biomass CHP plant development. TergoPower is a Norwegian-based company that has focused on developing green energy infrastructure in Poland since 2021. One of its flagship projects is the development of a 40 MWth biomass combined heat and power plant in Lublin, Poland.

We assisted the client with the environmental and social due diligence assessment of the biomass CHP plant project. In line with the client’s standard terms of engagement, the due diligence required the project to be assessed against applicable Polish regulations, EU Directives related to renewable energy and biomass, the OECD Guidelines for Multinational Enterprises, the Equator Principles, and the IFC Environmental and Social Performance Standards.

Our work involved reviewing disclosed and publicly available documentation, as well as conducting interviews with representatives from TergoPower and the assigned Engineering, Procurement & Construction (EPC) contractor. The reviewed documents included the Environmental Impact Assessment, technical studies, stakeholder engagement logs, and the EPC contractor’s EHS management system documentation.

EKF – Wind power, Mexico

EKF, Denmark’s Export Credit Agency, provides financial guarantees for projects that meet specific requirements for Danish economic interests, such as the export of capital goods. In issuing these guarantees, EKF, like all national Export Credit Agencies, must adhere to the OECD Common Approaches for Officially Supported Export Credits and Environmental and Social Due Diligence (the “Common Approaches”). EKF provides guarantees to multiple large-scale energy and infrastructure projects, including wind power projects worldwide.

We assisted EKF with the interpretation of the national regulatory frameworks of Mexico, performance standards on Environmental and Social Sustainability of the International Finance Corporation (IFC) , and best practice with reference to the ILO Convention 169 on the rights of indigenous and tribal peoples.
